I missed the last rally and I regret it. There was a moment in time when we were all really energized. The flower campaign was brilliant. But now we seem to have lost that fire - me included! I dont even remember my dates anymore. I know we have a serious problem of getting people together for anything. But starting small in our own cities and connecting to a national IV would probably work. I am here in Sterling Heights, MI (Detroit Metro Area) and I am willing to host people in my area It will be great if others in other cities can do that too. I am dre. ming, but think about it if this works. We can march to washigton again such large numbers that everyone will notice. I really think its time to get together and do something. Bouncing ideas on IV boards is great but lets meet and get to know each other and see if can talk about this problem face to face across the country. Thats what grassroot effort it!. If nothing, we will find new friends in each other. I hope to find that fire in us again and I thank you for reading my post!

call USCIS and ask them about the problem. If you get a good IO, they will open a ticket to consolidate. Try until, you get someone who sounds knowledgeable. Then take a infopass at your local office after a week to see if that helps any. I did that and took a infopass for this friday to check at local office. My PD is nov 2004. I will keep you posted.

I have checked with one of my co-worker who has two different A#'s too..is this is common..any way i am going to call USCIS and ask them

1. My lawyer clearly said you can't, unless you file it together with AOS.
2. I765 and I131 forms. Everything else has already gone in with the AOS.

I spoke with the USICS immi officer...she mentioned that you cant apply Ead/ap without A#..they will rject it and you cant update them later with the #

Hi Gurus

Here is my senario

I am in my 6th year of H1 which expires in Aug 2007.

I have my Labor (PERM) and I140 aprroved from my current employer.

I would like to tranfer my H1 to different employer .

can we apply for tranfer and 3 year extension of h1 to new employer with approved current labor(PERM) and 140(approved)

or should I need to tranfer my h1 forst and wait till FEB 2007 to apply my extension with approved labor(PERM) and 140 (approved ) from my current employer.

I really need your advise on this issue.

please help on this gurus.

If the offer is good you can take it .but your new employer has to start the PERM process immediately and you have every chance that labor and i140 will be approved so that you can file for 3 yr extension.
You can also keep the PD if your employer will not cancel the i140 once you leave the company and your new i140 is approved before they cancel.

You cannot apply the extension for 3yrs with new employer as your labor and i140 are tied to old employer.

This is a complex issue. That one point may have been the reason S-1932 did not go thru. It gives an impression as if 1/2 million employment based G.C's will be dumped into the market, but in reality the USCIS is able to process around 200k G.C's per year.
The current provisions in the CIRB target several areas and likely to keep the dates current for EB-1,2,3 current for a couple of years.
Our consultants have advised us well in this regard, if they have done so.

I concurrently filed 140/485 on July 1st. My case was moved to Texas and the receipt date was changed to August 28th on my 140/485. When can I can invoke the AC21? Is it 180 days from July 1st or 180 days from August 28.

Any response will be greatly appreciated.

I don't think all EB1's are PhD's. so if this bill is specifically for PhD's then its not gonna help EB categories.

Many of the EB1's I know are some global managers (by document) from some outsourcing companies with the same Educational / technical skills as many of us in EB 2/ EB3. after coming in on L1A they juz directly file under Eb1.

I am not trying to fire up an argument/fight. but juz the reality I know of.

Hope this bill will include People who have an MS degree . it will help clear up EB2 queue and eventually spillover the excess numbers to EB3.

I had the same thing happen to me, applied PP on June19, it reached on 20th got approved on June21. Status still shows pending, but the lawyer got the approval notice with an A# to boot...

Just to update, I got a CRIS mail that I was approved on the June21 and the online status changed to approved today....thats more than 2 weeks after the lawyer got the approval notice...snail mail seems faster then online notifications....why is everything so Topsy turvy with these guys only !!

Is your question about Approved 140 or Pending 140.
I am also curious to know.
As far as I know, employer has to just send a letter to USCIS with the 140 receipt number which states that they want to revoke it and USCIS will locate the file with 485 and revoke it too.
Bad but what can we do ???????

I am not sure whether to go for EB2 filing in PERM or wait one more year to file i485 (hope PD will reach 2003 september by next year october ). Even if i start EB2 perm now it's going to take at least one year to clear labor and i140 (if every thing smooth).

It should be worth it, because you didn't indicate the company would revoke your eb3+I140 approval.. Why not give it a try?

And if you start EB2 perm now, if everything's smooth, you may be cleared within 6-7 months (say, premium I140 is allowed for Eb2 then)

Due to time contraints doctor sent me for a chest x-ray and skipped the TB skin test. Chest x-ray came back negative. Question: Is a TB skin test required if a chest x-ray is negative? No remarks were made as to why TB skin test was not given. Should suggest, to a reasonable person, that no active TB is presentI've got a RFE because of that. Now got TB skin test and will do X-Ray again if TB will be positive.
